1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and West Solution Consulting Corp. ("we," "us," or "our"), governing your use of the Waymark application ("the App"). By downloading, installing, or using Waymark, you agree to be bound by these Terms. If you do not agree, do not use the App.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by updating the "Last Updated" date above. Continued use after modifications constitutes acceptance of the revised Terms.
2. Description of Service
Waymark is an iPadOS productivity application designed for recording, transcribing, translating, analyzing, and exporting session content. The App offers:
- Live speech-to-text transcription
- Real-time text translation
- AI-powered Intelligence analysis
- Photo capture and annotation
- PDF session report export
- Cloud-synced account and usage management
These features are delivered through a combination of proprietary technology and third-party service providers selected by us. We may change, add, or replace underlying service providers at any time without notice, while maintaining equivalent or stronger privacy protections.
All session content (transcripts, translations, notes, drawings, and photos) is stored locally on your iPad. We do not store your session content on our servers.
3. Account Registration
Waymark requires Sign in with Apple for authentication. By signing in, you authorize Apple to share your user identifier and, optionally, your name and email address with us for account creation purposes.
You are responsible for maintaining the security of the Apple ID used to sign in to Waymark. You agree to notify us immediately of any unauthorized access to your account.
Each physical device is limited to a maximum of 3 account registrations (lifetime). This limit cannot be reset and persists even after account deletion or device reset.
4. Free Allocation and Account Tiers
4.1 Free Allocation
New accounts receive a one-time free allocation of limited transcription minutes, translation minutes, and AI analysis credits. This allocation is provided once per account and expires 30 days after signup. Once the free allocation has been used or expired, it cannot be reactivated — even after account deletion, re-registration, or device change.
To enforce this policy, we retain an opaque, anonymous Apple identifier after account deletion. This identifier cannot be used to identify you personally. See our Privacy Policy Section 2.8 for details.
4.2 Lifetime Session Cap
Each account has a lifetime session limit:
- Free accounts (never purchased): 50 sessions maximum (lifetime)
- Purchased accounts (any purchase made): 350 sessions maximum (lifetime)
Once the lifetime cap is reached, you will be unable to create new sessions. Deleting sessions does not restore the lifetime count. This limit applies across all devices tied to your account.
4.3 PDF Export
PDF reports exported from free accounts include a Waymark watermark. Accounts that have made any purchase export clean PDFs without a watermark.
5. In-App Purchases (Consumable Credit Packs)
Waymark offers consumable in-app purchases ("Credit Packs") that provide additional transcription minutes, translation minutes, or AI analysis credits. Prices are displayed in your local currency within the App and are set through Apple's App Store pricing. All prices are subject to applicable taxes and may vary by region.
Credit Packs are subject to the following terms:
- Each purchase creates a new credit balance that expires 1 month after the date of purchase, regardless of whether the credits have been used
- Credits are consumed in order of purchase — the oldest purchased credits are used first
- Expired, unused credits are forfeited and are not refundable
- Credit Packs are one-time consumable purchases and do not auto-renew
- You may purchase multiple Credit Packs at any time; each creates an independent balance with its own expiry
- There are no subscriptions — you purchase credits only when you need them
We reserve the right to modify the types, quantities, and pricing of Credit Packs at any time. Changes will be reflected in the App and Apple's App Store.
6. Payments and Refunds
All payments are processed exclusively through Apple's App Store. We do not directly collect or store your payment information (credit card numbers, billing address, etc.).
Refunds are governed by Apple's refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly.
7. User Content and Data Ownership
7.1 Your Content
You retain full ownership of all content you create using Waymark, including but not limited to transcripts, translations, notes, drawings, annotations, photos, and exported PDF reports. We claim no ownership or license over your content.
7.2 Local Storage
All session content is stored locally on your iPad. We do not have access to, and cannot recover, your session content. You are solely responsible for backing up your data. Uninstalling the App will permanently delete all on-device session data.
7.3 Exported Content
PDF reports exported from free accounts include a Waymark watermark. Accounts that have made any purchase export clean PDFs without a watermark. Regardless of account status, exported content is yours to use, share, and distribute as you see fit.
7.4 Feedback
If you choose to provide suggestions, ideas, or feedback regarding the App or its features ("Feedback"), you grant West Solution Consulting Corp. a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use such Feedback for any purpose, including to improve the App and develop new products and services, without any obligation or compensation to you.
8. Acceptable Use
You agree to use Waymark only for lawful purposes. You may not:
- Use the App to record, transcribe, or translate content in violation of any applicable laws, including wiretapping, privacy, or consent laws in your jurisdiction
- Attempt to circumvent usage limits, session caps, billing mechanisms, device registration limits, or security measures through reverse engineering, tampering, or exploitation of vulnerabilities
- Use automated tools, bots, or scripts to interact with the App or its infrastructure
- Resell, sublicense, or commercially redistribute your Waymark account access
- Intentionally introduce malicious code, breach our security APIs, use unauthorized third-party clients, or attempt to compromise the App's infrastructure
- Install or run the App on jailbroken, rooted, or otherwise illicitly modified devices that bypass Apple's security sandbox
- Use the App's features to generate, store, or share content that is hateful, harassing, defamatory, illegal, or objectionable
Zero-Tolerance Policy for Objectionable Content: We maintain a strict zero-tolerance policy against the creation, processing, or generation of objectionable content, including but not limited to Child Sexual Abuse Material (CSAM), terroristic content, or severe hate speech. Because we operate with a structurally blind infrastructure where your personal content is stored exclusively on your device, we do not proactively monitor or review your content. However, we will enforce this policy to the fullest spirit and letter of the law. If we receive verifiable notification from our third-party infrastructure providers, are presented with concrete evidence by law enforcement, or if a user publicly posts offensive content explicitly attributing its generation to Waymark, we reserve the right to instantly and permanently terminate the associated accounts without prior notice or refund. We reserve the right to instantly and permanently terminate accounts without prior notice or refund for conduct that we determine violates these terms or is harmful to other users, us, or third parties.
9. User Behavior and Recording Consent
Important: Many jurisdictions require the consent of all parties to a conversation before it may be recorded. It is your sole responsibility to comply with all applicable local, state, provincial, national, and international laws regarding recording consent, eavesdropping, and wiretapping.
We do not monitor, control, or dictate how, where, or when you use the App. Because all session content is created by you and stored exclusively on your local device, you are solely responsible for your actions, the environments in which you record, and the consent of the individuals you interact with. West Solution Consulting Corp. disclaims all liability for any illegal, unethical, or unauthorized use of the App by you. We are not responsible or liable for any legal consequences, disputes, or damages arising from your recording, transcription, or translation of conversations without proper authorization.
10. Third-Party Services
Waymark relies on the following named third-party service providers to deliver its core features:
- Speech-to-text transcription — Deepgram Inc.: Audio is streamed to Deepgram in real time during recording via our server and is not stored after processing. (Privacy Policy | Terms)
- Text translation — Google Cloud Translation API (Google LLC): Text segments are sent from our server to Google Cloud Translation API v2 during active use. (Privacy Notice | Terms)
- AI analysis — OpenRouter Inc. → AI Model Providers: Transcript text, notes, and photos are sent from our server to OpenRouter, which routes to AI model providers, only when you explicitly tap "Analyze." Requests are submitted anonymously — no user identity is attached. (Privacy Policy | Terms)
- Apple Inc.: Authentication (Sign in with Apple), payment processing (App Store), push notifications, and device verification. (Privacy Policy)
Each third-party provider operates as an independent data controller with respect to the data they receive and is solely responsible for their handling of that data. We are not responsible for the independent practices of third-party service providers beyond the scope of data we transmit to them on your behalf. Once data has been transmitted to third-party providers, we do not have the capability to retrieve, reverse, or delete that data from their systems.
We may change, add, or replace third-party service providers at any time to improve quality, reliability, or cost, while maintaining equivalent or stronger privacy protections. By using these features, you acknowledge that your data will be processed by the named third-party providers according to their own data policies.
10.1 AI Model Training
When you use the AI Intelligence feature, your session content is processed by third-party AI language model providers via OpenRouter. We do not use your content to train AI models. However, the underlying AI model providers may process your inputs according to their own data policies, which may include using inputs to improve their models. We cannot guarantee that third-party providers do not use your data for their own purposes — refer to their individual policies. By using the AI Intelligence feature, you acknowledge and accept this possibility. If you do not wish your session content to be processed by AI model providers, do not use the AI Intelligence feature.
Your identity (name, email, or user ID) is not attached to AI analysis requests. Only the session content necessary for analysis is transmitted.
All AI models are accessed through OpenRouter under the same data handling practices described in our Privacy Policy. We may add, remove, or replace AI models at any time, provided they are accessed through the same intermediary under equivalent data handling practices. The current models in use are:

These are open-weight models hosted by infrastructure providers (e.g., DeepInfra, Together, Parasail) selected by OpenRouter. For details on how each provider handles data, visit OpenRouter's model pages.
10.2 Consent Withdrawal
You may withdraw your consent to third-party data processing at any time by discontinuing use of the App and deleting your account via Settings → Delete Account. Note that withdrawal of consent does not affect the lawfulness of any processing performed prior to withdrawal. Past data transmissions to third-party providers are irreversible. We retain an anonymized record of your consent history after account deletion for legal compliance purposes (see our Privacy Policy Section 7.3).
11. Intellectual Property
The Waymark application, including its design, user interface, source code, graphics, icons, logos, and documentation, is the exclusive property of West Solution Consulting Corp. and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iPads in accordance with these Terms and the Apple Licensed Application End User License Agreement (EULA).
You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works based on the App.
12. Disclaimer of Warranties
Waymark is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Accuracy or completeness of transcription, translation, or AI analysis outputs
- Uninterrupted or error-free operation of the App or its services
- Fitness for a particular purpose or merchantability
- Security of data transmitted to or from third-party services
AI-generated analysis is provided for informational purposes only and should not be relied upon as professional, legal, medical, financial, or any other form of expert advice.
Medical, Legal, and HIPAA Disclaimer: Waymark is entirely for personal productivity and is not a HIPAA-compliant service. It must not be used to process Protected Health Information (PHI) or similar legally protected health data. We are not a medical, legal, or financial service. Transcripts, translations, and AI summaries hold no evidentiary weight and cannot substitute for qualified professional advice.
12.1 Accuracy of Transcription, Translation, and AI Analysis
Waymark uses third-party speech recognition, translation, and AI language model services. These services are inherently imperfect and may produce errors, omissions, or inaccuracies. Specifically:
- Transcription may misinterpret words, names, numbers, technical terms, accents, or spoken content in noisy environments. Transcripts should not be treated as verbatim or legally accurate records of what was said.
- Translation may produce incorrect, incomplete, or misleading translations. Nuance, idioms, context, and specialized terminology may be lost or distorted. Translations should not be relied upon for legal, medical, financial, or safety-critical decisions.
- AI analysis may generate summaries, action items, or insights that are inaccurate, incomplete, fabricated, or misleading (commonly known as "hallucinations"). AI outputs do not represent verified facts and should always be independently confirmed.
You acknowledge and agree that all transcription, translation, and AI analysis outputs are approximate and provided solely as a convenience. You are solely responsible for verifying the accuracy of any output before relying on it or sharing it with others. West Solution Consulting Corp. expressly disclaims all liability for any damages, losses, or consequences arising from reliance on the accuracy of transcription, translation, or AI-generated content, including but not limited to medical, legal, financial, or personal decisions made based on such outputs.
13. Limitation of Liability
To the maximum extent permitted by applicable law, West Solution Consulting Corp., its officers, directors, employees, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, revenue, profits, goodwill, or other intangible losses
- Any damages arising from your reliance on transcription, translation, or AI analysis accuracy
- Any damages arising from unauthorized access to your account due to compromised Apple ID credentials
- Any damages arising from third-party service outages, errors, or policy changes
To the maximum extent permitted by law, in no event shall our total aggregate liability arising out of or related to these Terms or your use of the App exceed fifty Canadian Dollars ($50.00 CAD). This limitation of liability applies to all claims of any kind, including but not limited to damages, legal fees, attorney's fees, and court costs, whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. The existence of multiple claims will not enlarge this limit.
14. Indemnification
You agree to indemnify, defend, and hold harmless West Solution Consulting Corp. and its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the App in violation of these Terms
- Your violation of any applicable law, including recording consent laws
- Any content you create, export, or share using the App
15. Right to Refuse Service and Termination
Right to Refuse Service: We reserve the right to decline, deny, or refuse our services to anyone, for any reason, at any time, at our sole and absolute discretion.
Right to Interpret Terms: We exclusively reserve the right to evaluate user conduct and interpret these terms, guidelines, and our policies. Our determination regarding a violation of these Terms is final and binding.
Enforcement and Banning: We may suspend, disable, or terminate your access to Waymark without prior notice, including banning your IP address, blocking your Apple ID, or blacklisting your specific hardware device identifiers, for conduct that we determine violates these Terms, exploits our infrastructure, or is harmful to other users, us, or third parties. We take active measures against abuse, hacking, unauthorized third-party clients, reverse engineering, and API exploitation.
Upon termination:
- Your right to use the App ceases immediately
- We will delete your server-side account data, including authentication records, usage logs, credit balances, transaction records, and associated account information
- We retain an opaque Apple identifier, and may retain hardware or network details strictly for security blacklisting purposes, to enforce the one-time free allocation policy and prevent returning abusers
- Anonymized analytics events (with your user identifier removed) are retained for aggregate product improvement
- Your on-device session data remains on your iPad and is not affected by account termination
- Any unused purchased credits are forfeited and are not refundable
Sections 7 (User Content and Data Ownership), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), 17 (General Provisions), and 18 (Governing Law and Dispute Resolution) survive termination.
16. Force Majeure
We shall not be liable to you for any failure or delay in the performance of our services due to causes beyond our reasonable control. This includes, but is not limited to: acts of God, natural disasters, war, strikes, cyberattacks, server or database outages, internet infrastructure failures, or issues, disruptions, or downtime experienced by our third-party service providers (such as Apple, Deepgram, Google, OpenRouter, cloud database providers, or any other operational infrastructure). Such disruptions do not entitle you to refunds for expired or inaccessible credits.
17. General Provisions
17.1 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17.2 No Waiver
No failure or delay by West Solution Consulting Corp. in exercising any right under these Terms shall constitute a waiver of that right. A single or partial exercise of any right shall not preclude any other or further exercise of that right or any other right.
17.3 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Any attempted assignment in violation of this section is null and void.
17.4 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and West Solution Consulting Corp. regarding the use of the App and supersede all prior agreements, representations, and understandings relating to the subject matter herein.
17.5 No Partnership or Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and West Solution Consulting Corp.
18. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or your use of the App shall be resolved in the courts located in Ontario, Canada.
Legal Fees and Costs: In the event of any legal action, arbitration, or other dispute resolution proceeding between you and West Solution Consulting Corp. arising from or related to your use of the App or these Terms, the prevailing party shall be entitled to recover its reasonable legal fees, attorneys' fees, and court costs from the non-prevailing party.
Time Bar (Statute of Limitations): To the extent permitted by law, any claim or cause of action arising out of or related to use of the App or these Terms must be filed within one (1) year after such claim or cause of action arose, or it is forever barred.
Class Action Waiver: All claims and disputes arising under or relating to these Terms must be resolved on an individual basis. You waive any right to bring, represent, or participate in a class action, consolidated, or representative proceeding against West Solution Consulting Corp.
19. Apple-Specific Terms
The following terms apply as required by Apple's App Store guidelines:
- These Terms are between you and West Solution Consulting Corp. only, not Apple Inc. Apple has no obligation to furnish maintenance or support services for the App.
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
